Release of Liability and Media Consent

RELEASE OF LIABILITY AND ASSUMPTION OF RISK

ACKNOWLEDGMENT OF RISKS

I understand and acknowledge that hunting and related outdoor activities are inherently dangerous and involve risks that cannot be completely eliminated, regardless of the care taken by Major League Hunts LLC, its guides, landowners, or others.

These risks may include, but are not limited to:

• firearms, ammunition, archery equipment, and accidental discharge;
• actions of other hunters or members of the hunting party;
• ricochets, projectiles, gunfire, and hearing damage;
• wildlife, domestic animals, livestock, hunting dogs, insects, and other animals;
• uneven, muddy, rocky, icy, snow-covered, or otherwise hazardous terrain;
• holes, ditches, irrigation structures, fences, gates, roads, agricultural fields, farm equipment, and other property conditions;
• slips, trips, falls, collisions, and falling objects;
• hunting from, entering, exiting, constructing, installing, maintaining, or using pits, blinds, tree stands, boats, vehicles, trailers, or other equipment;
• carrying or moving firearms, decoys, blinds, equipment, harvested game, or other heavy objects;
• exposure to extreme cold, heat, wind, snow, rain, lightning, storms, and rapidly changing weather;
• bodies of water, rivers, ponds, lakes, ice, mud, drowning hazards, and unstable surfaces;
• darkness, low visibility, and travel before sunrise or after sunset;
• motor vehicle, ATV, UTV, boat, trailer, or other transportation-related accidents;
• remote locations and delays in obtaining emergency medical care;
• physical exertion, fatigue, dehydration, exposure, illness, allergic reactions, and pre-existing medical conditions;
• actions or omissions of other participants, landowners, guides, contractors, or third parties; and
• other risks that may be known, unknown, foreseeable, or unforeseeable.

I understand that this list does not include every possible risk associated with hunting or related activities.

VOLUNTARY PARTICIPATION AND ASSUMPTION OF RISK

My participation in hunting and related activities with Major League Hunts LLC is entirely voluntary.

I knowingly and voluntarily choose to participate with full knowledge that serious injury, permanent disability, paralysis, property damage, or death could occur.

I knowingly and voluntarily assume all inherent and other risks associated with my participation, whether described in this agreement or not, to the fullest extent permitted by law.

My assumption of risk includes activities associated with the hunt before, during, and after hunting, including scouting, transportation, walking to and from hunting locations, setting or retrieving decoys, entering or exiting blinds or pits, constructing or placing blinds or pits, handling harvested game, and other activities associated with the hunting experience.

RELEASE AND WAIVER OF LIABILITY

In consideration for being permitted to participate in activities provided or coordinated by Major League Hunts LLC, I hereby release, waive, discharge, and covenant not to sue the following parties, collectively referred to as the “Released Parties”:

• Major League Hunts LLC;
• its owners, members, managers, officers, employees, guides, agents, independent contractors, representatives, and volunteers;
• participating landowners;
• property owners, tenants, agricultural operators, lessees, lessors, and property managers;
• other persons or entities providing property, equipment, access, transportation, or services in connection with the hunt; and
• the respective successors and assigns of the foregoing parties.

To the fullest extent permitted by Colorado law, this release includes claims arising from the ordinary negligence of any Released Party, including claims involving personal injury, illness, permanent disability, paralysis, death, property damage, or economic loss.

I understand that by signing this agreement I am giving up the right to bring certain claims against the Released Parties, including certain claims that could result from their ordinary negligence.

Nothing in this agreement is intended to release conduct that cannot legally be released under Colorado law.

LANDOWNER AND PROPERTY RELEASE

I understand that Major League Hunts LLC may conduct hunts on privately owned or controlled property.

I acknowledge that participating landowners and property operators may not be present during the hunt and may not have inspected, identified, marked, or warned me about every potentially dangerous condition on the property.

To the fullest extent permitted by law, I voluntarily assume the risks associated with entering and using such property and release participating landowners and property operators from claims covered by this agreement, including claims arising from ordinary negligence.

I agree to respect all property, crops, livestock, fences, gates, roads, equipment, structures, and landowner instructions.

PARTICIPANT RESPONSIBILITIES

SAFETY RULES AND GUIDE INSTRUCTIONS

I agree to follow all safety instructions, hunting regulations, posted rules, landowner requirements, and lawful instructions provided by Major League Hunts LLC, its guides, employees, representatives, or agents.

I understand that I am responsible for safely handling any firearm, ammunition, archery equipment, vehicle, or hunting equipment in my possession or control.

I agree that I will not intentionally discharge a firearm in an unsafe direction or in violation of instructions provided by my guide.

I agree to immediately advise my guide of any unsafe condition or situation that I observe.

Major League Hunts LLC reserves the right to end or suspend my participation if, in its reasonable judgment, my actions create a safety risk to myself, another person, property, livestock, wildlife, or the public.

LEGAL COMPLIANCE AND PERSONAL FITNESS

I understand that I am responsible for complying with applicable federal, state, and local hunting laws and regulations, including licensing, tagging, firearm, ammunition, species, possession, and harvest requirements applicable to me.

I represent that I am physically and mentally capable of participating in the hunting activities I choose to undertake.

I agree not to participate while impaired by alcohol, illegal drugs, or any substance that would make my participation unsafe.

I understand that I am responsible for informing Major League Hunts LLC or my guide of any limitation that may materially affect my ability to safely participate.

INDEMNIFICATION AND PROPERTY DAMAGE

PARTICIPANT-CAUSED CLAIMS

I agree to be responsible for injury, loss, or property damage caused by my own negligent, reckless, intentional, or unlawful conduct.

To the fullest extent permitted by law, I agree to indemnify and hold harmless Major League Hunts LLC and the other Released Parties from third-party claims, damages, costs, or expenses, including reasonable attorney's fees, arising from my negligent, reckless, intentional, or unlawful acts.

This provision is not intended to require me to indemnify a Released Party for conduct that cannot legally be shifted or released under Colorado law.

PROPERTY DAMAGE

I agree to pay for damage that I cause through negligent, reckless, intentional, or unlawful conduct to property used in connection with the hunt, including but not limited to:

• blinds or pits;
• decoys;
• firearms or other rented equipment;
• vehicles or trailers;
• fences, gates, irrigation equipment, crops, or agricultural property;
• buildings or structures; and
• other landowner or Major League Hunts LLC property.

Normal wear and tear is excluded.

HUNTING CONDITIONS AND HARVEST EXPECTATIONS

NO GUARANTEE OF HARVEST

I understand that hunting involves wild animals and conditions outside the control of Major League Hunts LLC.

Major League Hunts LLC may provide services that include, depending upon the hunt, scouting, guide services, decoy spreads, calling, blinds, equipment, transportation, firearms or equipment rental, or other hunting-related services.

I understand that wildlife movement and hunting success may be affected by factors including:

• weather;
• migration patterns;
• hunting pressure;
• wildlife behavior;
• field or habitat conditions;
• land access;
• agricultural activity;
• government regulations;
• road conditions;
• equipment problems; and
• other circumstances beyond the control of Major League Hunts LLC.

Major League Hunts LLC will make reasonable efforts to provide a quality hunting opportunity but does not guarantee that I will see game, have an opportunity to shoot, harvest game, or harvest any particular number or species of animals.

I understand that the absence of a harvest does not by itself mean that Major League Hunts LLC failed to provide the contracted hunting service.

Cancellation, rescheduling, payment, and refund policies are governed by the applicable booking agreement or outfitting service contract.

GENERAL TERMS

SEVERABILITY

If any portion of this agreement is found to be invalid or unenforceable, that portion shall be limited or removed only to the extent necessary, and the remaining provisions shall remain in full force and effect to the fullest extent permitted by law.

COLORADO LAW

This agreement shall be governed by and interpreted under the laws of the State of Colorado.

ENTIRE RELEASE

I understand that this document addresses assumption of risk, release of liability, indemnification, participant responsibilities, and media consent.

Any separate booking agreement, outfitting contract, cancellation policy, payment policy, or other written agreement remains applicable according to its terms.

PARTICIPANT ACKNOWLEDGMENT

By checking I agree, I acknowledge and agree that:

• I have carefully read this entire agreement;
• I understand its terms;
• I understand that hunting involves significant risks, including the possibility of serious injury or death;
• I understand that this agreement includes a release of certain claims arising from the ordinary negligence of the Released Parties;
• I have had the opportunity to ask questions before signing;
• I have been given a reasonable opportunity to review this agreement;
• I am signing voluntarily and without coercion or duress; and
• I intend for this agreement to be binding upon me and, to the fullest extent permitted by law, my heirs, personal representatives, estate, and successors.

MEDIA CONSENT AND RELEASE

PHOTOGRAPHY, VIDEO, AUDIO AND LIKENESS RELEASE

I understand that photographs, video recordings, audio recordings, interviews, or other media may be captured during my hunt or related activities.

I grant Major League Hunts LLC permission to photograph, record, film, or otherwise capture my:

• name;
• image;
• likeness;
• voice;
• appearance; and
• participation in hunting and related activities.

I authorize Major League Hunts LLC to use, reproduce, edit, publish, display, distribute, broadcast, and otherwise use such media for lawful business purposes, including:

• websites;
• social media;
• advertising;
• promotional materials;
• printed materials;
• videos;
• digital media;
• educational or informational content; and
• other marketing or business communications.

This permission applies worldwide and may continue indefinitely unless otherwise required by applicable law.

I understand that such media may be edited, cropped, combined with other content, or adapted for different formats, provided it is not used in an unlawful or intentionally defamatory manner.

I understand that I will not receive royalties or additional compensation for authorized uses of my image, likeness, voice, or appearance unless a separate written agreement provides otherwise.

I release Major League Hunts LLC from claims arising solely from the authorized use of my name, image, likeness, voice, or appearance as provided in this section, to the fullest extent permitted by law.
